Terms & conditions
The terms that apply when you visit Derma Academy, create an account, make a purchase or use our digital products and services.
About these terms
These Terms & Conditions (“Terms”) govern your access to and use of derma.academy and the products, digital content, courses, resources and services made available through the website.
The website is operated by ATLAS MA LLC, a New Mexico limited liability company operating the Derma Academy website and brand (“Derma Academy”, “we”, “us” or “our”).
By accessing our website, creating an account or purchasing a product or service, you agree to these Terms. If you do not agree with these Terms, you should not purchase or use our products or services.
Our services
Derma Academy provides digital educational products and related online resources. Depending on the product purchased, this may include online courses, downloadable materials, educational resources, digital content or access to specific online learning services.
The exact content, features, access conditions and price of a product or service are described on the applicable product or checkout page at the time of purchase.
We may improve, update or modify our website and services from time to time, provided that doing so does not improperly remove access to something you have already purchased and remain entitled to receive.
Educational purpose
Content available through Derma Academy is provided for educational and informational purposes.
Unless expressly stated otherwise for a particular service, our educational content does not constitute individualized medical advice, diagnosis, treatment, prescription or a substitute for consultation with an appropriately qualified healthcare professional.
Users are responsible for determining whether information provided through our educational products is appropriate for their circumstances, professional role and jurisdiction.
Professional responsibility
Where our content relates to dermatology, aesthetics, skincare, healthcare or professional practices, users remain responsible for complying with the laws, professional standards, licensing requirements and scope-of-practice rules applicable to them.
Completing a Derma Academy course does not by itself grant a professional license, government authorization or legal right to perform a regulated procedure unless this is expressly stated and legally applicable to the specific program.
Eligibility
By purchasing from Derma Academy, you represent that you are legally capable of entering into a binding agreement under the laws applicable to you.
If you are purchasing on behalf of a company, clinic, organization or other legal entity, you represent that you have authority to accept these Terms on its behalf.
Accounts
Some products and services may require a Derma Academy account. You are responsible for providing accurate information and keeping your account information up to date.
Your account is personal to you unless a product expressly permits multiple users. You must keep your login credentials confidential and must not sell, transfer, share or otherwise provide unauthorized access to your account.
You are responsible for activity occurring through your account where that activity results from your failure to reasonably protect your credentials. Please contact us promptly if you believe your account has been accessed without authorization.
Orders and purchases
When you place an order through Derma Academy, you are offering to purchase the selected product or service under these Terms and the information displayed at checkout.
An order may be subject to payment authorization, fraud screening and other verification before it is accepted.
After successful payment and acceptance of the order, you may receive an order confirmation, receipt and instructions for accessing the purchased content or service.
We reserve the right to reject or cancel an order where reasonably necessary, including in cases of suspected fraud, unauthorized payment, obvious pricing or technical errors, abuse of our services or violation of these Terms. If we cancel a fully paid order without providing the purchased product or service, the applicable amount will be refunded.
Prices
Prices are displayed on the website before you complete your purchase. The currency applicable to your transaction will be shown on the relevant product page or during checkout.
You are responsible for reviewing the total amount displayed before authorizing payment.
Where taxes or other mandatory charges are required to be collected, they may be calculated and displayed during checkout or included in the displayed price, as applicable.
Payments
Payments may be processed through third-party payment providers integrated with our ecommerce platform.
By submitting payment information, you represent that you are authorized to use the selected payment method and authorize the applicable payment provider to process the transaction.
Payment processing may be subject to additional terms, verification, security checks and privacy practices imposed by the applicable payment provider.
We do not guarantee that every payment method will be available in every country or for every transaction.
Digital delivery and access
Most Derma Academy products are digital. Unless otherwise stated on the product page, no physical product will be shipped.
Digital access may be provided through your Derma Academy account, a secure access page, download link, email or another method described when you purchase the product.
You are responsible for providing a valid email address and maintaining the technical equipment, internet connection and compatible software reasonably necessary to access digital content.
The duration of access, where applicable, will be stated on the relevant product or course page. References to lifetime or permanent access, if any, are subject to the continued availability of the relevant service and any specific conditions communicated with that product.
Refunds and cancellations
Refund eligibility depends on the type of product or service purchased and the circumstances of the request.
Because many Derma Academy products contain digital content that may become available immediately after purchase, different cancellation or refund rules may apply once digital access has been provided, downloaded, streamed or otherwise used, subject to any mandatory consumer rights applicable to the customer.
Our complete refund and cancellation rules are described in our Refund Policy, which forms part of these Terms. Please review that policy before making a purchase.
Nothing in these Terms or our Refund Policy limits any refund, cancellation or consumer right that cannot legally be excluded or restricted.
Chargebacks and payment disputes
If you believe a payment was made incorrectly, you were charged more than once, you did not receive your purchase or you have another billing issue, please contact us at support@derma.academy so that we can investigate the issue.
We may provide transaction, account, access and communication records to our payment provider or financial institutions when reasonably necessary to investigate or respond to a payment dispute or chargeback.
Fraudulent use of payment disputes, including knowingly disputing a valid transaction after receiving and using the purchased digital content, may result in suspension of access while the matter is investigated.
Intellectual property
Unless otherwise stated, the Derma Academy website and its original content, including courses, videos, lessons, documents, graphics, text, downloads, educational materials, branding and other resources, are owned by or licensed to ATLAS MA LLC and are protected by applicable intellectual property laws.
Purchasing a product gives you a limited, personal, non-exclusive and non-transferable right to access and use the purchased content for its intended purpose. Purchasing access does not transfer ownership of the underlying intellectual property to you.
What you may not do
Unless we expressly authorize it in writing, you may not:
- Copy or reproduce substantial portions of our paid content
- Share purchased courses or account credentials with unauthorized users
- Resell, sublicense or redistribute our digital products
- Record or redistribute protected video lessons
- Upload our paid materials to file-sharing platforms or other websites
- Remove copyright, trademark or ownership notices
- Use our content to create an unauthorized competing copy of a Derma Academy product
- Attempt to bypass access controls, payment systems or website security
- Use the website for fraudulent, unlawful or abusive purposes
User submissions
If you send us a support request, review, message, form submission or other content, you remain responsible for the information you provide.
You must not submit unlawful, malicious, infringing or intentionally misleading content or use our communication systems to interfere with Derma Academy or other users.
Availability of the website
We aim to keep Derma Academy and purchased digital services reasonably available, but uninterrupted availability cannot be guaranteed.
Temporary interruptions may occur because of maintenance, security updates, hosting problems, internet failures, third-party service interruptions or circumstances outside our reasonable control.
Where reasonably possible, we will work to restore access to affected services without unnecessary delay.
Third-party services
Derma Academy may rely on third-party services for functions such as payments, hosting, email delivery, analytics, security and ecommerce functionality.
Third-party websites and services may have their own terms and privacy policies. We are not responsible for independent third-party websites or services that are outside our reasonable control.
Disclaimer
We make reasonable efforts to provide accurate and useful educational content. However, information, professional practices, scientific knowledge, regulations and industry standards can change over time.
Except for warranties or rights that cannot legally be excluded, our website and educational content are provided without a guarantee that particular educational, professional, commercial, medical or other results will be achieved.
Your results may depend on factors outside our control, including how you use the information and your individual circumstances.
Limitation of liability
To the maximum extent permitted by applicable law, ATLAS MA LLC will not be liable for indirect, incidental, special or consequential losses arising from the use of Derma Academy or its products where such liability may lawfully be limited or excluded.
Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by applicable law, nor does it remove mandatory consumer rights that apply to your purchase.
Suspension and termination
We may restrict or suspend access to an account where we reasonably believe there has been fraud, unauthorized account sharing, infringement of our intellectual property, misuse of the website, a security threat or a material violation of these Terms.
Where appropriate, we may contact you and provide an opportunity to resolve the issue before permanent termination.
Privacy
Our collection and use of personal information is described in our Privacy Policy.
Our use of cookies and similar technologies is further described in our Cookies Policy.
Changes to these terms
We may update these Terms when our products, business practices, technologies or legal requirements change.
The current version will be published on this page with an updated revision date. Changes will apply prospectively unless applicable law requires otherwise.
Governing law
These Terms and your use of Derma Academy are governed by the laws applicable to ATLAS MA LLC in the State of New Mexico, United States, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your country of residence provide rights that cannot legally be excluded by this provision.
Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
